Is it too good to be true? Did Portfolio Recovery just make a mistake?? *Help!*

Hi -

I did a DV with Portfolio Recovery 5+ months ago and yesterday! I finally got a response. The response included the top sheet with my personal information and the total amount owed - nothing new and exciting or anything that could even be close to considered validation there. BUT - what was also included was my "Bankcard Statement Information". I don't know if this is enough for validation either and it doesn't really make too much sense (it's as if it was shrunk down to fit an 8 1/2 x 11 sheet of paper and really needed to be much larger). BUT (another but :D ) what I was able to make out was that I have something called Bill Unpaid Fin CHG starting in 4/3/2004. I live in NYC and the SOL here is 6 years!

Am I correct in thinking that Portfolio just made my case for me? Is it too good to be true?

OK. One thing I noticed when I pulled my TU report. It says the tradeline from the OC should be deleted in 10/10 (which is this month - yay!). BUT when I got to EQ of who I've tried to dispute a few times now, it says Date Reported 6/10 - which is BS. Does this mean it won't fall off of EQ?

I'm not the most learned person on this forum, but I've been reading long enough to give some advice.

You should be able to figure the SOL date by going back to the line on the credit report for the original creditor (OC). See when your last payment was made before the account defaulted and add 180 days. That is the start date of SOL.

Use this forum and website to find violations you can sue them for. Either sue or threaten to sue. Let them know that the account is time-barred and they cannot sue you for the debt. Let them know that you'll drop everything if they remove from the credit reports. Let them make their move.

Actually, you should just be able to write to the credit bureaus and let them know the true aging of the account. Be clear and even include copies of items from your credit report as evidence. Ask them to remove as the time period for them to report has passed. If this doesn't work, try what I mentioned above.

Somebody can correct me if I'm wrong on any of this.

it says Date Reported 6/10

That simply means the date the information was reported. It doesn't mean the date of your last payment. Your information should still come off at the correct time.
