New Collection Letter

LVNV filed a lawsuit against us in 2009. We responded, requested discovery, and LVNV dropped the case a year ago. They are still reporting on my hubby's credit report.

Today, he got a letter from a new CA who is collecting for another CA (not LVNV) about that very debt. It's outside the SOL, by the way. I'm going to send them a nice little letter telling them to eat dirt.

Here's my question: If LVNV sold the debt to this new agency and no longer owns it, am I correct in stating that LVNV can no longer report to the CRAs?

I received a new letter from a CA for the LVNV account that I had dismissed in June 09 as well. The situation is exactly the same & the new CA shows Trakamerica as the creditor as well. The letter was from Tate & Kirlin Assoc.

I was considering sending a copy of the dismissal from the court along with my DV letter.

That's who sent my letter. I haven't decided if I'm going to send them a letter or not. I might just sit back and do nothing and see if they file a Complaint. If they do, I'll file a countersuit for suing outside the SOL.

If it's outside the SOL, tell them to eat dirt. Don't forget about the time the SOL was tolled due to the lawsuit, though.

You still need to DV to preserve your rights, and don't DV Tate & Kirlin, DV TrakAmerica or otherwise you will be playing the same whack a mole crap that LVNV puts you through. TrakAmerica will simply send it on to another CA to collect for them. Ask for a DV and mention SOL, LVNV already lost in court, and whatever else. 8-)
