retmar Posted November 20, 2010 Report Share Posted November 20, 2010 I'm looking for input from everyone who has knowledge of Payday Loans and what they can and can't do, experiences, anything you might know. Yes, I have to read our state's statutes on this, but, would appreciate all anyone can share. The matter I'm helping on now is following in a short version, mostly highlights. My first with one of these.A consumer went to a Payday Loan and took out a loan, which included their writing a check for the amount, etc. All normal procedure. Due to loss of job, was unable to pay at time due. Told them payment would be made as soon as possible, but, must wait for a job, or other source of income. Treated nice, with the old "we understand", blah, blah, stay in touch. A short time later, the problems began. The first call in the morning was answered and relayed to them that the situation has not changed and unable to pay until, just as originally told in beginning. Before the end of the day, four more calls from same person, and, same response from consumer. This continued each day following. Consumer finally stopped answering. A couple weeks later, an employee showed up at door wanting paid, plus, handing the consumer a letter, as it "is a policy that we hand deliver this letter". The letter only related the amount claimed, and other "stuff". Nothing as required by statute. California holds OC's liable if they attempt to collect their own claims, so the FDCPA does apply. A couple of weeks later, they called one of the people noted as a reference, left a message asking them to tell the consumer to contact them, as they can't get in touch with them. Yes, message was transferred to tape. Made statement as to the consumer failing to show up for an appointment they were supposed to keep. Consumer never agreed to meet. Today, another one from the office called the same reference. They claimed they have no phone number for consumer, and cannot get in touch with them, and would the reference please tell the consumer to contact them. They also called another reference where they told them it was for a debt, and other remarks that may be unacceptable. I have to wait for their statements to see exactly what was stated.Yes, I have all intent of having great fun with this one. There is more on this, but, for space will stop here. I'll still look to see what may be displayed as excerpts. I'll probably have to rely on my state's statutes only.
