Midland Credit Management

Hi, everyone I am new to the forums and this is my very first post.

I need some advice on dealing with Midland Credit Management (MCM). They are reporting a $2800.00 debt to Verizon Wireless on my credit report. I disputed this information with the CRA and it came back verified. I was about to send them a DV when I got a letter from them requesting "more information" to help settle my dispute. They updated the TL to show "customer disputes this account information" in the interim. They are asking for receipts to show I paid the account or a letter showing a balance different than what they show, etc....

Correct me if I am wrong but the burden of proof is on them to show I owe the debt, not mine to prove I don't right? I was thinking of send them a DV and putting that somewhere in the letter. Sounds to me like they are trying to trick me into admitting I owe the debt in order to let them off the hook with validating. This debt is from 2004 , early 2005. I live in South Carolina SOL is two years. I know this will be falling off my credit reports in the next year and a half or so but I want it off now as it is very damaging. Any ideas on how to proceed?

You could send them a letter stating that you are unaware of this debt, and ask them to prove you owe it and that they OWN it. If they don't have the evidence to prove they own it, you could send copies of the correspondence and "evidence" to the CRAs with an explanation and request it be removed.

You could also try a pay for delete, but that doesn't always work. I would never try that with a JDB unless I was desperate for the TL to be removed.

If all else fails, unless you're trying to buy a house or car, you might just wait until it falls off.

$2800? Is that amount correct?

Hmm? Be careful with this since you mention SOL and then this statement above. The SOL to which you refer is one for initiating a successful lawsuit NOT a reporting SOL which is much much longer. So even when you are out of the first SOL you are stuck in the second for around 7.5 years total.

Unless you meant that this is a very old debt like 5 years already?

This letter loosely translates to...

"we have no real documentation to support our claim against you. Please provide us with some."

This is a common trap to attempt to bait you into acknowledging the debt, the amount, payment history, etc. Once you recognize the debt, you lose certain rights due to you.

I would not recommend communication with the CA. The burden of proof relies on them. The law does not require capitualtion to their claim.
