Georgia Judgment for DEFENDANT! Midland Funding LOST! I rock!

Just wanted to say thank you to everyone for your input and advice.

Today I had a bench trial in Georgia, Midland Funding vs. Me. It was not dismissed, I actually got judgment in my favor. And even better, I'm getting my hearing for attorneys fees and costs (I had an attorney initially in my case but not in the latter part of the case).

Midlands case was as simple as this. "The Plaintiff Rests, Your Honor." I immediately moved for a directed verdict. (If you dont know what this is, find out cuz itll be your friend!)

I give more details later, just wanted to let you know about the win!! 8-)

They rested without putting on any evidence?

P.S. Congrats to you. Think of how you felt when this case was filed. You never would have imagined it would come out this way. And now, YOU will have a judgment entered in your favor. Won't that look nice on the ole credit report?

That is my question. They actually went as far as trial and then did not even try to present any evidence or was their evidence so faulty that you got it thrown out and hence, they had no evidence?

If the former, I wonder what the judge thought because most reasonable attorneys would have dismissed before getting in front of a judge and basically state they have no evidence.

Most of these cases no matter where in the country just won't be prosecuted with admissible evidence. Therefore no one should ever lose one of these cases. All they have to do is what you did. They have to do the research and show up ready for a gunfight.

That you filed a cross prevented them from running away and hitting you again in six months like their move from magistrate to state court.

You did everything right. That Midland was too stupid to write you a check speaks volumes. They knew there was no way they would win at trial. Why they would risk a straight up or down ruling is just beyond reason. In the end their poor judgment got them what they deserve, a loss.

Filing a cross in most instances should have gotten you at least $4,0000. Guess the Midland/Hanna make different kinds of business decisions. That they went to trial with no evidence is indicative of their decision making skills.

Intimidation of the niaive is their biggest weapon, they have until the 11th hour to use if they can't then they're sunk. S.A. Be Bless!
