Make sure you can use the existence of an arbitration clause as an affirmative defense.If it was me and I could use the existence of an arbitration clause as an affirmative defense, it would be my first affirmative defense...something like:The court lacks jurisdiction over the subject matter due to the existence of an arbitration clause in the contract.Good luckRL Link to comment Share on other sites More sharing options...

jackson212 Posted January 12, 2011 Report Share Posted January 12, 2011 +1 on lack of standingbecause un1fun has failed to provide proof of assignment, or full chain of assignment from original creditor to current assignee, or valid bill of sale identifying the alleged account, uni1fun has not established its standing in this action. because un1fun lacks standing it may not proceed in this action.
