Sillysabrina Posted March 5, 2011 Report Share Posted March 5, 2011 I just got a letter in the mail today Stating" Notice of New Ownership and Pre-legal review.Midland Funding LLC recently purchased your Citibank account and midland credit management, inc, a debt collection company, is the servicer of this obligation.MCM,inc. is considering forwarding this account to an attorney in your state for possible litigation. However, such forwarding will not occur until after the expiration date of the time period described on the back of this page. Upon recepit of this notice, please call to discuss your options.If we dont hear from you or receive payment, we may proceed with forwarding this account to and attorney.So this is the letter that I got today. Please help. I have never received a letter like this. I should agree and call them to arrange payment methods or should I decline?I dont have money to pay them and I cant afford an attorney nor do I want to get thrown in jail or go to court.Any guide is greatly appreciated. Thank you in advance1) You can not go to jail for owing a bil collector;2) The letter speaks of turning your file over to an attorney for consideration of legal action. If a court action is coming it will some time away.3) Instead of worrying, you can spend some time digesting this forum and learning about your options for dealing with your situation4) If you don't hane any money to pay them, then there is nothing to be gained by worrying about that which you can do nothing about. And, just to begin with: you should never call a collection agency; that every communication should be in writing. Secondly, you should send them debt validation letter within 30 days time frame..again you can find the sample letter on this site. Another very important thing: check if MCM is licensed in your state to collect (you can google this). Finally, check the statue of limitation in your state for such alleged debt. Midland is one of the nasty ones; I had to deal with them in the past. Dont be afraid: empower your self with knowledge. Is the debt still within the SOL?No matter what Midland does, they have to prove they own the debt and that the amount is correct. I agree with the previous posters. Do some research. Is the debt still within the SOL?Its only been about 10 months since i haven't paid a dime. I was wondering, If I should call them and see if they can lower it. I want to pay it, but im not sure if I should deal with them since there seem to be some fraud. I want to pay them and have it taken off my credit report. BV80 Posted March 6, 2011 Report Share Posted March 6, 2011 You can contact them if you want, but I would make sure they own the account before paying them a penny. If they don't own it, you could get a notice from another JDB who can claim they purchased it. Also, if Midland agrees to let you pay a lower amount, they could sell the remainder to another JDB who'll come after you for that.As far as a pay for delete goes, they may or may not agree to that. Midland is not known for honest tactics. If you decide to do anything with them, get everything in writing. In fact, I'd make them notarize it.
