minxcomp1 Posted March 7, 2011 Report Share Posted March 7, 2011 (edited) I pulled my credit report the other day and noticed that there is a JDB listing 12 accounts on my report all with different amounts and dates. I sent a PFD letter CMRRR for 50% (overly generous I thought) of the total debt. They returned a denial letter stating I owed the entire amount with a list of the OC's original account numbers. There are only 3 different accounts from the OC!! So the JDB is reporting 4 accounts for every one of the OC's accounts!! Is it legal for a JDB to do this? And how do they put different reporting dates for the same OC account?!? These accounts are the only negatives on my CR and need them off ASAP because I am purchasing a house in the next month or so!! Please advise on my next step!! Thanks in advance!! They may not be allowed to settle if they are collecting for the OC. That would be a deal the OC would have to make. If they own the debt and are the JDB then they can settle. It takes a few times. Nothing will happen overnight. Let them continue to call you and make them an offer everytime. If they decline, they will call back another day for the money. If the Debt is outside the Statute of Limitations, they have no right to collect anyway, send them a SOL letter. But yes, they can report a tradeline per every original tradeline. The OC has never been on my credit report just this JDB. The SOL varies anywhere from this June to Oct 2012. How can they list different reporting dates for a single OC account number?? I feel that I am not portraying clearly as to what they are doing..For the OC's account number (xxxx001 for say $250), the JDB is reporting on my CR four of their accounts (xxxxx01 for $25, xxxxx02 for $75, xxxxx03 for $100 and xxxxx04 for $50) alll with different reporting dates...I hope this makes more sense as in all of my searching, I have not found another case like this!! BV80 Posted March 7, 2011 Report Share Posted March 7, 2011 Per the FCRA, their entries must be accurate. Breaking an account up into several accounts is not accurate, in my opinion. Dispute the debts with the JDB. If you're desperate to try to resolve the matter, dispute with the CRAs also. Be very detailed about the inaccuracies.Demand the JDB prove they own the debt and have the right to report. Are the debts within the SOL? If not, make them prove the date of last payment, as well.I'm not positive, but such reporting could be a violation of the FDCPA (using unconscionable means to collect a debt). If they verify all of the debts, they could also be in violation of the FCRA. Here's a link to the FCRA. Check out section § 623. Responsibilities of furnishers of information to consumer reporting agencies. The very first part of that section states that they can't furnish information they know or have reason to believe is inaccurate. It seems to me that's what they're doing by breaking the accounts up.http://www.ftc.gov/os/statutes/fcradoc.pdfBe sure and go through the entire statute.
