lawyer says I have nicer car than he does lol

so after my msj hearing, about a month ago the lawyer watched what car I got into to drive off into the sun. 2006 ford fusion

so today when were talked on the phone and I tell him I have no money he then tells me I drive a nicer car than he does.

he could have been full of it but who knows, i just thought I would share this

Hell, tell the attorney if he would learn how to successfully litigate..more money would come his way..and he also could afford a nice car.

ha ha no kidding, I thought i had outsmarted him by waiting in the lobby for 10 minutes after the motion.

He must have been waiting in the parking lot to see if I was driving away in abeemer

Call the attorney and say "picky,picky, picky"...and tell him the next time he is to appear in court, you will give him a ride...if his clunker won't start, or if he can't afford a nice car,,,there are several places in town which will "tote the note"....and he can pay by the week...provided he wins any judgments.

Kinda sad a hot shot attorney has nothing better to do than troll around a parking lot waiting to see what some lowly pro-se drives.

I'd just tell him that it has 250,000 miles on it and is unfortunately only worth about $600. Then proceed to tell him that's all you can afford on your fixed judgment-proof income which comes from SSI/Disability. I might also add it's a shame you don't own any property or other tangible assets to liquidate so you can get some cash to buy another vehicle.

That might make him much less interested in you, your car, and your case! :wink:

Reminds me of a landlord I had once who was required to replace the oven because it stopped working, and then complained that the tenants have nicer things than she does. What do apples have to do with oranges? Just griping for the sake of emotional manipulation.

Many lawyers do that here in Minnesota because parking around the courthouse is at a premium and most of the cases are defaults because of the pocket docket rules. Had it been me, I would have walked or taken the bus to the courthouse simply to beat the lawyer at this game. Of course, considering what I drive, if the lawyer said my vehicle was better than his, I would have laughed in his face (I drive a vehicle that is worth salvage yard value).

Simply tell the lawyer that there is a huge loan on the vehicle and by the time you add the loan and your value that you can keep ($3500 I believe), there is nothing left.

Even though I put my car in a relatives name two years ago as a precaution just in case I lost a suit and it might be subject to be taken, I still take the time to park out of sight of the courthouse so what happened to you, the lawyer seeing your car, didn't happen to me. My case hasn't even went to trial but I just chose to be safe and not sorry.

I am not sure if that might be something he could bring up in court if they won or not, judging by the way the folks on here are reacting, probably not.

These lawyers that represent these JDB's are certainly a unique sort of insect that is for sure...lol

Remind him that you also smoke MORE EXPENSIVE CIGARS THAN HE DOES !

Now tell the attorney that the three piece suit he was wearing sure was nice...it would have been much nicer if it had fit properly...and both pants legs were the same length.

Maybe the lawyer doesn't piss his money away on vehicles and instead puts his cash to work on things like educating his kids and building a nest egg so he can retire at 50.

This thread is absurd.

ONLY TO LAWYERS PERHAPS ..and if an attorney intends to retire at 50, then he needs to earn that privilege in some other manner, rather than preying on the down trodden..you know, those who don't have the strength or stamina to fight back.

...as far as using his money to send his kids to college..well that works both ways...he just might wind up paying for some one else's kids college education, while scrambling to protect his a$$-ets. It is not beyond the realm of possibility !

This thread would not even exist IF THE ATTORNEY HAD NOT MADE THE "ABSURD" REMARK about "the car being nicer than his"...now that remark was "ABSURD".

I have noticed that over the years that more and more of our constituents are learning how to fight back, and in the eyes of the Collection Industry, JDB's and attorneys..THIS IS "ABSURD"...or is it actually "poetic justice" ?

Knowledge is "POWER"...and more and more people are becoming "Powerful"

...now ain't that ABSURD !!

and by the way, are you an attorney , an agent of a CA or JDB ?...AND SINCE WHEN IS FREEDOM OF SPEECH OR THE PRESS ''ABSURD" ?

I think we should "poke fun" at all of these guys..they have been laughing at debtors, "real or alleged" for years....until educational forums such as this became available !

Actually, the actions of this attorney are absurd. First off, unless the attorney has a way to determine that the car is truly owned and not just used by the defendant, no matter what happens, the attorney cannot reach the car. And if the attorney does have a way to do that, they did not need to watch what car the defendant got into. That almost borders on intimidation. There are many reasons a person could be driving a car the do not own (both legal and illegal).

As for the lifestyle the lawyer is living, that is still not the lawyers responsibility to tell the debtor they are suing. In fact, unless there is some negotiation, the lawyer ought to be preparing for a trial, not determining what assets the debtor has. That would be if and after the get the judgment. Owning a nice car does not matter if they cannot prove I own the debt.

Get the judgment first, then worry about the assets.

It's all part of the intimidation game. From what I can tell 90% of the "work" these collection and JDB attorney types do is intimidation. They'll scare you, bluff, make empty threats...it's all part of the game of getting into someone else's head.

Odds are the lawyer was talking out his @$$ and really had no idea what car the OP even drives. Either that or he was fishing a little bit and trying to get the OP to tell HIM what sort of car he has. I'm pretty sure sniffing around for assets is a common tactic for their "research" and for intimidation purposes. It's amazing how much talking people will do with an attorney and how much info they will "give away".
