Those rules should tell you how to file for a continuance, as well as when you should receive a summons prior to an appearance...whether or not you were given the proper amount of time. fightemdontfold Posted March 8, 2011 Report Share Posted March 8, 2011 If you were served with a complaint, you should have 20 to 30 from the day you were served from what I have read.However if this summons is really a motion, then 12 days is probably enough time. I have filed motions and only allowed 5 or 6 days notification to the JDB suing me. You will need to show up for the court date if it is a motion, they might award a default if you don't.Is this the first notification of this suit or have you known about this??
