Need some suggestions with a collector

Long story short.

Had an MRI and surgery in Aug.

Insurance was slow to pay, but after it was all hashed out, I sent the MRI company a check for the balance they said I owed on Jan 5th

Some time shortly before or after I paid, the MRI sent it to a collection agency.

Collection agency called today and I told them it had been paid.

She said for me to make it go away, I needed to send them proof that I had paid it, and that it was accruing 8% interest.

I told her that if she was worried about it, to call the MRI company, but that since I have a canceled check for the full amount, as far as I am concerned this matter is closed and we have nothing else to discuss.

Any ideas as to what to throw at her when she calls again?

Offer to send a copy of the canceled check with the bank and account information redacted? Either that or call the MRI organization and discuss this with them. Third option is to send a C&D letter but that would simply land you in court which although you could prove you paid, it would be an annoyance.

If you don't want to send the CA a copy of the cancelled check, why not write the OC stating you piad it by check # XXX on DATE, you have cancelled check that cleared your bank on YYY date and you require them to recall from CA and ensure any negative reporting is deleted.

I suggest that you send a CERTIFIED letter to both the MRI company and the CA along with a copy of THE DUNNING LETTERS and your canceled check, advising them that if they didn't resolve this matter WITHIN 5 DAYS OF RECEIPT OF YOUR LETTER, AS EVIDENCED BY THEIR SIGNATURE AND DATE RECEIVED ON THE RETURNED green card, that you reserved the right to FILE A COMPLAINT WITH THE STATE ATTORNEY GENERAL as well as the US Post Office fraud Division charging them both with mail fraud under US CODE TITLE 18 CHAPTER 63, COLLECTIONS ( FRAUD AND SWINDLES)...And if they pursued this matter in court, you would then counter with a charge of MALICIOUS PROSECUTION as well as COMMITTING FRAUD UPON THE COURT.

Send the letters to the CHIEF EXECUTIVE OFFICER AND GENERAL MANAGER OF ACCOUNTS...AND MAKE IT VERY CLEAR THAT YOU INTEND TO HOLD BOTH PARTIES "CORPORATELY AND INDIVIDUALLY RESPONSIBLE" for this matter."

I DEMAND YOUR IMMEDIATE REPLY, STATING YOUR INTENTIONS.

Close by stating: "you have been advised, now you should govern your action accordingly"

NOTE: BY LAW, THE CA IS REQUIRED TO SEND YOU A LETTER WITHIN 5 DAYS OF INITIAL COMMUNICATION ( per the telephone call) WAIT UNTIL YOU GET THE LETTER TO REPLY !
