LLinsen928 Posted March 14, 2011 Report Share Posted March 14, 2011 My husband and I are being sued by Enerbank for $4995.00 plus interest. We origianlly obtained the loan back in March of 2009 when a water softener salesman came to our house. We thought we would never be approved because my husband was unemployed at the time but to our suprise Enerbank gave us the loan. As time went on my husband was not able to find a job and we were unable to make the payment. We sent letters (certified) to Enerbank explaining our situation and offered to pay them a lesser amount each month but they never responded to our offers. They also called my place of employment several times a day despite being informed by me as well as my employer that I could not receive phone calls at work. They would also call my work and say that I needed to call my bank and leave their number. I sent certified letters as well telling them to stop calling me at work. They also called family members and told them that we owed Enerbank money and wanted to know if they could get a hold of us. Now we are being sued by them and don't know where to turn. BV80 Posted March 14, 2011 Report Share Posted March 14, 2011 If the calls had been made by a collection agency, there would be FDCPA violations. I don't know if Florida has fair debt collection laws that extend to original creditors, or not.If it were me, I'd call a consumer attorney. Most attorneys give free consultations.
