I have no way of proving these dates though. I am almost positive that these accounts have been suffled thru three different CA's and I think they have been re-aged. I have disputed them, and they came back as to fall off my report in 2014. 7.5 years prior would put them created in 2006, but I know that is not the case... What can I do? I would like to post my problem here two. Maybe both of us can get an answer here from those in the know.My problem is I had an Ex make off with an RV during our divorce in 2008. The OC keeps posting it as of Dec. of each coming year. i.e 12-08 then 12-09 then 12-10. I presume they are re-aging it on me. in TX the SOL is 4 years and I have a year to go. The last payment was made about May of 08.She had the RV in pocession, so the court gave it to her, she later defaulted on it, but it was a joint account and I have deeper pockets. I tried to copy my CR to post here, but its a little flakey. The last payment was made about May of 08.When you say the "OC keeps posting as of Dec., etc"...are you referring to the "date reported"? If so, that's simply the date they are reporting the status to the CRA. The 4 year SOL to which you're referring is the SOL for collections. The SOL for reporting negative accounts to credit reporting agencies is 7 years. Since the last payment was made in May/2008, the entry should fall off your credit report somewhere between June to November of 2015. Link to comment Share on other sites More sharing options...

They actually called me last night because I went on all three of the CRA's and disputed the date they were reporting. After speaking with the CA, they proved to me that I was actually in the wrong. I was getting accounts messed up. The account I thought this was, actually expired last year. From doing the research on here, I knew the difference on the SOL for being reported and the SOL to be sued. This is what I am talking about: Balance Date 12-2010. If you will look at the three bureaus reporting above, you might be able to see what I am talking about. It was hard to copy all three at once over.I really like this site a lot of help. Prosay Posted March 16, 2011 Report Share Posted March 16, 2011 I think if the date of last activity(payment, etc) shows the matter is outside the SOL, THEN THIS SHOULD PROVE YOUR CASE.It is the responsibility of the PLAINTIFF TO PROVE that it is WITHIN THE SOL ! BV80 Posted March 17, 2011 Report Share Posted March 17, 2011 TomnTex,It's difficult to say without seeing the report, but it could mean as of 12/2010, the balance was being report as $31,762.00. If it was being reaged, the date of the first major delinquency would have been changed to reflect a more recent date. I'm not sure what they mean about "prior delinquency". I know that it was early 2008 that the last payment was made, like about April or May.After that, it would show Balance Date 12-2008, 12-2009, then 2010. To me, it looked like they were re-aging it. Sure hard to tell. I only have another year for the TX SOL to run out. I am lucky though. I am buying a house and the bank ignored this with a divorce decree showing that the debt, even though joint, belonged to her. Maybe others might have an idea of whats going on.
