YourBudWeiser Posted March 18, 2011 Report Share Posted March 18, 2011 So my father has an old judgement and the creditor filed a motion for a writ of garnishment against his bank account which was granted. He then filed a standard form and an affidavit claiming Social Security benefits exemption. The plaintiff attorney filed an objection to exemption claiming that my father was not entitled to head of household exemption. Now a hearing must be held based on the objection, tying up his funds and causing him alot of stress. I think it's just a delaying tactic.My father claimed Social Security exemption, not head of household exemption.
