State Claim Adjusters

I originally received a phone call at work, after they called my relatives (my mothers home) to contact me about a 'claim', from State Claim Adjusters(SCA) in early January 2011. SCA stated I owed a $1200.00 balance on an account from First Merit Bank, from 2003. They wanted me to set up automatic withdrawls from my checking to pay it. I delayed them, and they called a few other times, speaking with co-workers to find out when I would be available. Finally I took their call and requested proof, they emailed me a collection letter with an account number for First Merit Bank.

I found this website/forum and sent (email and Certified Mial Receipt) on 01/20/2011 a request for debt validation (obtained from this site), which included all requests for, who, what, when, how much, was owed, and to stop all phone calls, and stated all of my rights, and reply within 30 days.

I hear nothing and receive nothing until I had a voice mail at work on 3/9/2011 at 3:52pm EST from Jeff of SCA to return a call. Then I received another collection letter dated 3/11/2011, with a settlement amount of $275.

I feel they didn't prove the debt, violated my rights by calling my place of work and leaving a voice message, and failed to prove the debt within the 30 day limit.

Do I have the right to sue them?

If your C and D said not to contact your work or telephone then yes. The law specifically says they can not call your work once they know that calls of that nature are not allowed by your employer. If so then they have violated the C and D and they have an FDCPA violation.

So did they ever send you anything at all or did they just start up collection procedures again without sending you the debt validation info?

They did not send me any information at all to prove the debt is mine. They just sent another (2nd) letter that offered the reduced settlement amount.
