Paid medical bill to OC, how do I deal with the CA now?

Hello everybody,

Yesterday I received a letter from a CA for a medical bill that was due last October and by the way I never received it. I called the OC right away, they told me that the bill had been sent out to my address and was returned twice because the address wasn't correct.

I verified my address with them and they did have the right address so I am very upset.

Anyway, they told me that if I paid the bill with them over the phone they would call the CA and inform them that the bill had been paid. So I did it.

Soon after I was told that it was a mistake and that I should never have paid because the CA is going to report it anyway and it's going to show on my credit report.

I am unfamiliar with all this I recently moved to the states so it's all very stressful to me.

My question is: is the CA going to report the debt to the CRA even if I paid the bill to the OC upon reception of the letter from the CA?

If so, what can I do to request that the debt be deleted from my CR?

They can and do this all the time.

What you should try is contacting the person at the OC you dealt with and ask them to resind/recall the debt back from the CA and delete the account from your reports as it was erronious.

I did two of these last week where I went to the OC and told them I would pay them in full on the spot if they called the CA, recalled it and asked them to remove all listings from my credit reports. I just had them type me a quick statement saying that upon receipt of payment they would recall the debt and ask the CA to remove the listing from my credit reports.

Boom.. went super smooth and easy and they were both off of my reports yesterday.

I did this a while back.

The CA would not play ball at all for a 100$ collection. I was offering to pay in full for a deletion. They simply told me that they did not delete - period.

I just wanted it off of there. It was getting close to the SOL, but not quite there yet.

I figured it was a long-shot, but I called the OC anyways and they dug through their records and still had the account. I payed them over the phone and got confirmation of everything and had them fax a receipt.

I forwarded everything to the CA and within a week the account was gone.

The OC just called me back to inform me that they asked the CA to delete my account. I hope they will.

Should I still send a validation letter to the CA or just call them to make sure they deleted my account?

I would send a letter to the CA telling them that they should have gotten a recall notice from the OC due to error and that no debt is owed. They received the file by mistake.

It's not a lie. There was an error in mailing so you didn't know what you owed. You paid it directly as soon as you found out (but you don't have to tell the CA that).

Based on that, if the CA doesn't remove the tradeline they would be in material violation of the FCRA and the FDCPA...so in all likelihood it will be gone from your reports in short order.
