Need assiatnce with these two situations - Please..

Greetings all,

Q1 . I live in Maricopa County, State of Arizona and have two questions. A CA was awarded a judgement (Summary Judgement - Cap One) a few months back. My spouse and I filed for BK-13 on Jan 2011. Can I vacate this judgment for $8k, since I filed? I just don't want to see an open judgment like that.

Q2. Another JDB sued us for $11k in AZ Superior court, and was going for a summary judgement when we ruined their day by filing BK-13. I sent the court a "Notice of BK" so the judge would not grant or postpone their request for summary judgement. That went well, the case was dimissed, but I would like to have the entry of: "NOB Notice of Bankruptcy" removed from the case history, as this can cause issues at my job. I know BK records are public, but someone woud need some sort of access to PACE or something like that. In AZ, Superior court records are very public, and i would rather have someone see a dismissed judgement, but not showing how it was done.

Are these possibel to achieve?

Do you have a lawyer for this chapter 13? With all these judgments amount to alot of $$ The courts would have to approve the repayments of these bills. Isn't chapter 13 where you have to repay the bills and the court sets a schedule and a monthly amount? If you have all that $$ amount I would try to file a chapter 7, and yes, if you qualify for chapter 7 the judgements can be removed but you probably need a lawyer to do this. Do you have a lawyer? I do not know the answer to your 2nd question about getting things removed from your credit report. This bankruptcy you are doing is also going to show on your credit report so I don't know what the difference would be.

Talk to your attorney about vacating the judgment by Cap One. He may charge you a little extra to do it, but it is worth it. I assume that the judgment was awarded before the BK filing. If it was awarded afterward, then you can have the entire thing removed and the attorney for Cap One sanctioned.
