It keeps coming back. What now?

Recommended Posts

I have a collections item that keeps reappearing on my Experian report. This is the 3rd time it has happened. I dispute it with Experian and they remove it. It stays off for about a month and then it comes back. This is now the 3rd time it has come back. I have all 3 letters that Experian has sent me saying it was deleted. What do I do to make this go away and stay away. I thought about doing dv or disput with oc but it is my understanding that you should dispute with the reporting agency 1st. I do dispute with Experian 1st each time. They take it off and then it comes back making me start all over again. I have seen on this site that they are required to let me know that they are placing the item back on my report. Is this true? If so I have never received a letter saying it was put back. I have only received letters saying it was deleted. What do I do and how do I do it from this point. It seems pointless to dispute with Experian again as I know they will take it off. I also know it will be back about a month latter.

You do 2 things: send Experian a letter telling them that by thrice putting am item back on your report after deletion without telling you about it they have thrice violated the fair credit reporting act and will be sued for said violations. You will likely have to frame this as an ITS letter, with lawsuit paperwork ready to file to show these idiots the gravity and seriousness of the situation.

Since you DID dispute with Experian first, go ahead with the 623 dispute with original creditor procedures. One way or another that neg. Is going away once and for all.

I sent the dv letter from your sample letters and have not had a response yet. Sent it certified mail and am now just waiting. It is not deleted but there have been no kd entries added to my report from them. Now is another waiting game. I will update when I find out the results.
