Bank of America cc settlement %age

Been haggling my 18k+ severely late cc w BofA for months now, they sent me settlement letter offering 12, then 6, and two months ago 5k, but now they are not budging. I was hoping to get them down to 3 or 4k.

Anybody settle with them recently in the 10-20% range?

I can't afford 5k in 3 months, but I also don't want it to go to collections (already have a citi cc debt that just went to collections after I tried to get them down from their 50% settlement offer).

Thanks

Just recently finished a settlement with them with almost exact same numbers. Owed a little over 19k and haggled forever. Finally played the waiting game and 2 days before charge off the rep told me basically that even at this late date there was no way they were going below 5k according to his notes.

Since charge off was 48hrs away I finally caved and set up the settlement at around 25%.

Sorry I dont have better news for you.

The verbiage on the settlement letter they sent me said the typical answer to your question is if you are unable to make the final payment by the final agreed upon date then the settlement agreement is void and they will continue to pursue whatever remedies they have available.

Translation: You no longer have a settlement but they get to keep any money youve sent them as payments on your agreed upon settlement plan youve already made.

Example: you agreed to settle 10k for 3k paid over 3 months, 1k at a time. You make your first 1k,then your second then you come up 10 bucks short on the third. No more settlement. They keep the 2995 youve already paid and still attempt to collect the difference up to the 10k they say you owe.

So youve accomplished nothing and given away money you could have either kept or used to settle other accts (assuming you have any).

So try and be pretty sure you can finish a settlement you start paying on if at all possible.

  • 4 months later...

We just settled 3 different cards with them with a total balance of $45K for about 19%. They were very respectful and nice through the entire process and gave us 4 months to pay. We just started and the letters do state that if we default the agreement is null and void.

We live in a very depressed area in Ohio and because of our rental business and people not paying their rent we are in this bind. I don't know if that is why we got a little better deal.

Citibank on the other hand is sticking at the 45%, and on one card they have filed for a judgment so I will be spending quite a bit of time here with all you wonderful, helpful people.
