mad as hell
Do you think I am safe this one? I am sure it will get passed around, but after 90 days and nothing, I would think they are not gonna validate
Flyingifr
There is no time limit on Validation. but as long as your VOD request was made within 30 days of initial communication they cannot attempt to collect. Expect them to simply send the debt off to another collector where you start the process all over again.
Hal Jordan
That's where I'm at. I got a small collection that started at Sunrise. I dv'd them and got nothing back. I disputed immediately with the CRA's and Funny thing, Sunrise verified the debt with all 3 CRA's in February 2011. About a week later RJM showed up on my TU AND EXPERIAN CR as the exact same debt. Turns out Sunrise sold the debt to RJM in december 2010. I called each CRA and they were all very nice and immediately deleted Sunrise as a duplicate of RJM. I disputed RJM with experian online and they (RJM) finally sent me a letter a few days latter letting me know they take all disputes of their debts to the credit bureaus very seriously and offered me a settlement. I responded with a I take all violations of the FDCPA very seriously and will not hesitate to take legal action against companies who report false debt to my reports and demanded proof. They waited 3 weeks then deleted themselves from my reports. no letter no nothing. Just fell off my CR's.I expect they will just sell it off again to another collector and I'll have to battle this thing for years. Johhnychampion
If they are reporting on credit reports, do they have to delete if they validate?

They dunned me years ago telling me they were my "new creditor" and that they were "not a collection agency" boldly imprinted on the dunning letter. $23,000 they were seeking on an old MBNA Account. They folded like a cheap tent when challenged to prove their claim. $23,000 debt extinguished. Gone, kaput!!
