moogie33 Posted July 27, 2011 Report Share Posted July 27, 2011 (edited) I have spent many hours reading all the information available.Well it works,don't let these people run oveer you.They got a default judgement ,never served me.I found out about it when the lawyers started calling me saying to contact them because something was about to happen to me that would adversely affect me.I didn't call them,I ran my credit report saw midland,checked the courthouse for any cases with my name ,saw Midland got default judgement $6700.Went to courthouse took two days to get info,was told because I am on soc sec disability to ignore it they can't collect.They can put the judgement as a lein on my home if I sell ,I pay .Of course collecting 10% int all the while.I asked for a motion to set aside and dismiss with predujice the judgement.They didn't show up ,judge granted dismissal with predudice.I was never served and had proof I was home and due to a surgery was not able to answer the door to be served.Had my hospital paperwork to prove it.Thanks to everyone . Nice going. You did the right thing. I am glad you didn't listen to the advice about ignoring this.Did they make you pay a first appearance fee when you sought to vacate the default? If so, you should ask the court to award you that amount as fees. Obtaining a dismissal in your favor makes you the prevailing party entitled to recover your costs.Nice work.
