will.hall Posted July 29, 2011 Report Share Posted July 29, 2011 Original Post located under my profile (I can't post URLs--I'm too new)I'll make this short.1) Received Complaint/Summons (roughly $1,500 lawsuit)2) Filed Answer3) Three days later received motion to dismiss without prejudice in the mail from the plaintiff's lawyer's office.My question is what do I do now? jackson212 Posted July 29, 2011 Report Share Posted July 29, 2011 you can probably file your own motion to dismiss with prejudice for lack of standing.whether you file your own motion is up to you, but you should ask for costs and fees because they basically wasted your time with this lawsuit.a dismissal is good and i'll take that anytime.i think SOL in your state is 3 years, so this dismissal is good.when is DOFD do you know? how old is this debt? Do I have anything to lose by filing my own motion to dismiss with prejudice? Worse case scenario it's just dismissed without prejudice?
