kifmn Posted August 1, 2011 Report Share Posted August 1, 2011 Is there any way for me to stop a garnishment with a creditor on the grounds that they transferred the debt? If they transferred the debt, shouldn't they quit garnishing me? I would like to make arrangements with the new creditor but, I can't when all the money is still going to the old creditor. Chances are that the new third party collector should not be trying to collect on it. To answer your question the judgment currently being executed trumps any claims made by other parties, unless the original creditor recinded it from the law firm that filed the original summons and complaint.
