I'm helping out my boyfriend with this.My boyfriend rec. a notice of garnishment from his work. He had no idea about this. He works for a large company with stores all over the US. It seems that the collection agency #1 sent it to one of the stores in MI and from there that store in MI sent it to the corporate office where they mailed it to his home. He called the collection agency to see if he can set up some kind of payment plan. They told him they can't until Sept and it cant be less then half of what is being taken out( They are taking out about $182 every 2 weeks). Hes figures that we can survive we just have to tighten our belts which is fine with me. Well 3 days later i rec a txt from my bank that we are $1900 in the red. I freak out because we had $420 in the acct for the car payment. I call the bank and they inform me that there is a lien on the acct for 900 and some but in the state of IL they double that amount for my boyfriend(we have a joint acct. Im the primary). They inform me that I should contact the collection agency #2(mind you this a different one from the garnishment) that I'm the primary on the acct to see if they will remove the lien. Well I call them and the basically they tell me your out of luck. I ask if I set up payment plan would that help. They say I can but I would have to send them money orders but nothing would be done till everything is payed off. He had set up payments over the phone with #2 back in 2009 for $50 every month. The crazy thing with #2 is that they can only set it up for 6 months at a time and they would call him when it was close to the end of the 6 month time. He never rec a call or letter from them. He thought he was done with all the payments. What should we do? Some one said he should file for bankruptcy and he would get all his money back . Help!! BTO429 Posted August 2, 2011 Report Share Posted August 2, 2011 Then try writing the collector and demand they send you a copy of the judgment if they have one.Go to the bank they have to provide a copy to the bank before they can freeze your account. If the bank has a copy ask for a copy for yourself if they will give it to you.If they wont give you a copy ask them if they will at least give you a docket number or tell you which court it came from. If you can figure out if they have a judgement, and if they do you can file some paper with that court.See if you can find out and let us know and we can help.
