floridacclawsuit Posted August 13, 2011 Report Share Posted August 13, 2011 (edited) Hey folks,I filed a Motion to Strike Plaintiff's Affidavit and Bill of sale and I have a hearing scheduled for the 16th next week. While looking through my paperwork I just figured that I had forgotten to strike the Credit Card Statements. I've found the pleadings I just don't know how to amend or make an addition to my original motion to strike? Or should I just file a separate motion to strike for that part only /the statements/ and tell the Judge that I faxed and mailed a copy to the plaintiff on Monday 15th. I will call the judicial assistant on Monday asking for a different hearing date. Thanks for your help! BTO429 Posted August 13, 2011 Report Share Posted August 13, 2011 File a motion for continuance (motion for leave) to amend pleadings. Depends on what court you are in what it is called. If I file a second motion to strike the account statements which I had forgotten about is it gonna be a big mistake? Is it allowed to file the same motion with a different content again?
