what is required to file ch. 7? is it 2 yrs of bank stmts and 6 mo.of income?

Recommended Posts

It is more paperwork than just 2 yrs of bank statements and 6 months of income.

The attorney will have a list for you of information for you to supply to them which in turn will be turned over to the Trustee (if the Trustee requests it). Have you had any interviews with BK attorney's?

Common requests include tax returns (2 to 4 yrs), mortgage documents (up to 10 yrs), deeds, w-2's, 1099's, car titles and/or vehicle loan info, credit card statements, etc. There is a long list of items, some of the items do not apply to every case. The idea is for you to prove your financial status with actual documentation. The Trustee can also ask for supporting information during your BK. Generally the standard list is all that you need. Your BK attorney will have that list for you when you interview.

If you don't have an attorney and you are not using one, then download the BK petition to get an idea of what you need to respond to the questions.

Some sundry items:

...copy of most recent federal tax return, given to trustee no later than seven days before the 341 meeting

...credit counseling certificate

...wage stubs, if employed, for the prior sixty days before filing

...a repayment plan if one was developed during the credit counseling session, usually online

....and later on, after the 341 meeting, proof of completion of a personal financial management course--again, taken online

The basic forms:

Form 1: Voluntary Petition

Form 3A: If paying the filing fee of 299 in installments

Form 3B: If applying for a fee waiver

Form 6: Schedule A--Real Property

Schedule B--Personal Property

Schedule C--Property Claimed as Exempt

Schedule D--Creditors Holding Secured Claims

Schedule E--Creditors Holing Unsecured Claims

Schedule F--Creditors Holding Unsecured Priorty Claims

Schedule G--Executory Contracts and Unexpired Leases

Schedule H--Codebters

Schedule I--Current Income

Schedule J--Current Expenditures

Summary of Schedules of A through J

Statistical Summary of Certain Liabilities

Declaration Concerning Debtor's Schedules

Form 7: Statement of Financial Affairs

Form 8: Chapter 7 Individual Debtor's Statement of Intention

Form 21: Full Social Security Number Disclosure

Form 22A--Statement of Current Monthy Income and Means-Test Calculation

Form 23--Certification of Instructional Course on Financial Management

Form 201: Notice to Consumer Debtors Under 342 of the BK Code

MAILING MATRIX

Local forms, if any

The only problem might come from Form 22A, which involves some math. Generally, filling out the forms is straightforward and a lot them will not apply to many people, those to be designated "none" or "n/a".

Correct. But to the point of the question above, last year's tax return (if you don't have one, the IRS will send a tax transcript that trustees must accept), and 60 days paystubs or proof of income of some kind.
