The reason I ask is because I have small claims case against a debt buyer and I filed a Motion to Dismiss. The Plaintiff responded and sent Interrogatories and all that other fun stuff. The judge then set a hearing date for October and my answers are due later this month. The reason I want to Object to Discovery all together is because if I WIN my Motion to Dismiss the answering of the Interrogatories because irrelevant correct? heretohelp Posted September 8, 2011 Report Share Posted September 8, 2011 did p have leave of court to file interrogatories? in Indiana small claims actions, either party must first be granted leave of court. if they did not, you can do a motion to strike their interrogatories.
