LostSomewhere Posted October 7, 2011 Report Share Posted October 7, 2011 I sent a validation request certified to NCC (A division of Commonwealth Financial Systems) in Winxom MI.The letter was returned today refused.What are my options?I can resend it to a different address, I can send it to the address where they want payment. WhoCares1000 Posted October 7, 2011 Report Share Posted October 7, 2011 If it is marked refused, they you do not have to do anything more. Wait for the FDCPA violation then sue. The courts have ruled that you cannot get out of a violation by refusing a CMRRR letter. Otherwise, the IRS would never be able to start collection proceedings on those who owe taxes if they could claim they never received any notices because they refused to sign for the final letter.Consider your letter to be delivered as far as you are concerned.
