anonymous2011
I live in California and wondered if a certain company can operate in the state? The company is not listed with the Secretary of State or any of their aliases. I found a thread that had to do with Illinois and New York but not California?Anybody have any info on this? 1stStep
Techically, they can try to collect from you. If they file suit, they'd have to be registered w/ Sec of State. If they are not, be sure to call the Franchise Tax Board - they levy fines up to $10k for this...
legaleagle
It depends on who you are referring to. If it is a junk debt buyer, they own your account legally and can file suit against you anywhere you live. They are not acting as a debt collector at that point, they are acting as a plaintiff. No license is required to bring suit. If they are a collection agency acting on behalf of the creditor, they probably have to be licensed. Some firms do both, like Midland. Be sure who is bringing suit.
1stStep
In California, a company must be registered with the Sec of State in order to file suit ... I'll find the Corporation Code section...
