Coltfan1972
You have a judgement against them?
DaFish
Yes. Now, I need them to pay up!
Guest usctrojanalum
TBH, they are not likely to voluntarily pay it. When it comes to corporations and judgments, they are like consumers and judgments. 80% of them will not pay it off voluntarily.
1stStep
Midland is in San Diego... you will need to get a writ from your court first (EJ-130). Then send it down to the SD Sheriff and they will have to execute it - I don't recall the fee off the top of my head (but that gets added to the writ). I bet that once the deputies show up, they will cut a check pretty quick.
VLDCA
Hey I won against Midland August 9, 2011. I sent a letter to their Atty on Sept 6, 2011 & then another letter on Oct 4, 2011 & then I received my chk in the mail on Oct 11, 2011 from their Atty. So it took me a little over 2mths to get a chk.Hope you get it here soon!
Seadragon
Or have the SD sherriff walk out with a Blade Server or something equally nice.just sayin
Coltfan1972
Know a guy that showed up at a CA call center with a Uhaul. He paid the bond and law enforcement started with the laser printers. The check, including interest and fees he paid to enforce the judgement, was wired to a local branch bank in an hourIt was not Midland but was still one of the funniest things done to a CA. DaFish
Thanks all! I think I would rather walk out with the servers then have a check! I would also take his "degree" off the wall to hang on mine!
DaFish
another question....the judgement is $350 plus post judgement interest of 10% from the date the judgement was entered. Is that 10% per month? Week, day, or just 10% of $350?
1stStep
It's 10% annually...in your case, a little less than $3 per month - or about $0.10 per day.
DaFish
found it! It's per annum.
Guest usctrojanalum
It's 10% per year. So a year from now your balance will be $
1stStep
An idea I had to get your cash faster...Send Midland's attorneys a letter - let them know you're planning to speak to Turko in San Diego (he's one of those pitbull consumer reporters). His station is down the street from Midland's HQ. Bad publicity is probably something they want to avoid...
DaFish
Great idea 1stStep! I did that with So Cal Edison when the waffled on replacing a vault cover in front of my house...I cc'd a management type and they had it done within the hour! DaFish
Well a rep from Midland called last week and said that they would be sending a check, he wasn't sure when, but they would be sending one. I gave them a week and I called this morning. He put me on hold and came back after a long wait and said "accounting wasn't cooperating and he didn't know when they would be sending it and that he would be getting back to me". I told him that I would be filing a Writ of Execution and would send a SD Sheriff over with Mike Turko from KSCI San Diego with a camera crew to collect the check and he said "do what you gotta do" and then preceded to try and talk over everything I said. So, I just kept talking and every time he would try to talk, I did the same to him, very calmly. When I asked for his Supervisor, he said "thats me", so I told him great, I'll have the TV crew ask for you by name and hung up!
Meli
Let us know when you get your check! I'm being sued by Midland in San Diego court so I love hearing how you are fighting back! Can't wait to see Turko get 'em!

Did they cave in and dismiss or did you have a trial?Me too! But once you pick it up (the jargon) it falls into place. I went to court and beat them on the Bill of Sale ((BOS). Judge said since my name or account number wasn't on the BOS they couldn't prove ownership of my account!
