How do I get Midland to pay my judgement?

TBH, they are not likely to voluntarily pay it. When it comes to corporations and judgments, they are like consumers and judgments. 80% of them will not pay it off voluntarily.

Midland is in San Diego... you will need to get a writ from your court first (EJ-130). Then send it down to the SD Sheriff and they will have to execute it - I don't recall the fee off the top of my head (but that gets added to the writ).

I bet that once the deputies show up, they will cut a check pretty quick.

Hey I won against Midland August 9, 2011. I sent a letter to their Atty on Sept 6, 2011 & then another letter on Oct 4, 2011 & then I received my chk in the mail on Oct 11, 2011 from their Atty. So it took me a little over 2mths to get a chk.

Know a guy that showed up at a CA call center with a Uhaul. He paid the bond and law enforcement started with the laser printers. The check, including interest and fees he paid to enforce the judgement, was wired to a local branch bank in an hour

It was not Midland but was still one of the funniest things done to a CA.

An idea I had to get your cash faster...

Send Midland's attorneys a letter - let them know you're planning to speak to Turko in San Diego (he's one of those pitbull consumer reporters). His station is down the street from Midland's HQ. Bad publicity is probably something they want to avoid...

How did you beat midland? their attorney is suing me in nj for cc debt..any info is appreciated!

I read this forum inside and out, learned the local rules of my court, I listened to advice given me by the above folks and others and I took 1 -2 hrs a day to learn as much as I could about fighting these clowns. It can be done, it takes a little hard work though....

Do you have any good interrogatories I can send them..here in nj we are allowed 5 only. What did you ask for?

Well a rep from Midland called last week and said that they would be sending a check, he wasn't sure when, but they would be sending one. I gave them a week and I called this morning. He put me on hold and came back after a long wait and said "accounting wasn't cooperating and he didn't know when they would be sending it and that he would be getting back to me". I told him that I would be filing a Writ of Execution and would send a SD Sheriff over with Mike Turko from KSCI San Diego with a camera crew to collect the check and he said "do what you gotta do" and then preceded to try and talk over everything I said. So, I just kept talking and every time he would try to talk, I did the same to him, very calmly. When I asked for his Supervisor, he said "thats me", so I told him great, I'll have the TV crew ask for you by name and hung up!

LOL it takes me 1 or 2 hours just to learn the definitions of the jargon! Congrats though. Did they cave in and dismiss or did you have a trial?

Me too! But once you pick it up (the jargon) it falls into place. I went to court and beat them on the Bill of Sale ((BOS). Judge said since my name or account number wasn't on the BOS they couldn't prove ownership of my account!
