crash5050
I have all but one negative removed from mBig 3 creidt reports, but I hav eone little poodunk collection agency refusing to wrok with me. The have me marked as KD in April of 2011 and showing the account opened in July of 2001. I think that would fall under both re-aging and false reporting. Should I Sue?David
WesleyD
I would say that you have to make sure every proofs you have should be accurate or else they would have a ground to sue you in return. Perhaps, it's better to hear a couple of advice from experts first or from consultation firm before finally deciding.

Should I Sue?DavidI assume you've already disputed the entry with the CRAs. Is the OC still reporting? If so, what does their entry state? Also, is the CA reporting a date of first delinquency? thomassl
I agree with BV80. Many people confuse the "date of last activity" with the "date of first delinquency"....the prior one could be any date that "any" activity was done on your account. Don't let them fool you into thinking the account is newer than it is with this language. If they do indeed "re-age" your account, go after them! crash5050
Thier response was I didn't get the account until June, how could I have opened it before then? Well, how can you KD me in Feb when you didn't have the account?
1stStep
Have you disputed it w/ the CRAs? If not, then to get an FCRA violation, you have to start off with a dispute...
