RD23
Yesterday, I ordered my three credit reports. I received my Equifax report online. Under Closed Accounts it showed Asset Acceptance Corp. as account holder with Chase number (which has been charged off) as Account number with date opened 12 /2010 and Delinquency Reported 01/2012. I pulled my last credit report in March of 2011 and it get not show this Account at that time. How can I remove this from my credit report or can I. What action can be taken if any? I am a newbie to the legal arena, and any help will be thankful.
1stStep
Send a dispute to Equifax via Certified Mail -Return Receipt Requested. If Equifax cannot verify in 30 days, it will be deleted.

BV80
Can Asset Accceptance file claiming to be a new creditor on my credit report.Yes, Asset can report. They're either collecting for Chase, or they've purchased the debt. Just make sure they're reporting accurately. If the debt is merely charged off, they're collecting for Chase. If Chase's entry states "sold/transferred" or "transferred to another lender"...something along those lines...then Asset has purchased the debt. RD23
Thank you 1ststep and BV80. I have one more question. Where does the S.O.L. start to run. Does it reage with Asset or does it stay with Chase?
BV80
Thank you 1ststep and BV80. I have one more question. Where does the S.O.L. start to run. Does it reage with Asset or does it stay with Chase? The SOL for reporting stays with the OC. It's 7.5 years from the date of 1st delinquency that the OC is reporting. I am a newbie to the legal arena, and any help will be thankful. Can anyone give me info, law statue or demand letter to send to Asset Acceptance to list the S.O.L. as the time of last payment to Chase, which was two years prior. Do I have to send the credit bureaus a demand letter first? Can I force Asset Acceptance to sue me in court or can I sue them. If I can which court do I take them or is it better to take the credit bureau to Federal Court? I am a newbie and I am not an attorney. I have the utmost respect for the consumer attorney.Thank You,

You just draft the complaint, summons, walk in the clerks office, hand them $350.00 and then serve the other side. I've yet to hear of a violation or a valid cause of action, but you don't need anybody's permission to file a lawsuit. You got some great advice a few months prior to dispute with the credit bureaus. Did you do that, and if so, what was the response(s).
RD23
You got some great advice a few months prior to dispute with the credit bureaus. Did you do that, and if so, what was the response(s).Yes, I did get excellent advice. I did follow through with the advice and sent the three CRA'S request to validate. They returned my request stating that the account was accurate. My question is: How do I request that Asset's reageing of the account is incorrect. How do I state this in a letter. Can I find some form letter that fits this area of question.Thank you for your help.

That's the date Asset got the account and opened it in their files. It has nothing to do with the "date of first delinquency" on the OC's entry. That's what determines the 7 year reporting period. Coltfan1972
BV80 is correct, they opened the account when they got the account. With that said, Asset is probably one of the top five worst there are. I'd do the 623 method next, then you are laying your foundation for a lawsuit.
