How to approach CBCS and Directv

I just got a letter in the mail from CBCS attempting to collect an Alleged debt to directv for 584.12. The letter was dated 4 February 2012.

I have read enough to know that I need to send a DV letter to CBCS, and obviously they aer going to come back and say we verified it and it is yours.

I cannot deny that I owe part of this bill, but most of it is for the equipment they never sent me a mailing box and shipping label for it's return.

Directv has a JAMS clause in the terms of use. Since I am not familiar with the arbitration process I need a bit of guidance. I have busted my rump over the last couple of months getting old stuff off my credit and even got a CH 13 BK removed a year early from all 3 reports. I do not want these non english speaking creeps at CBCS to report this, I know they cannot speak english because they have called me 4 times since I got the letter to try and get me to admit to the debt.

So would arbitration help me out? What steps should I take? Should I send DV letters to both CBCS and Directv? Should I write an informal dispute resolution letter to Directv before submitting a demand for arbitration? Will the 60 day grace period on the informal dispute get the CA off my back and off my CRA's? Should I just go ahead and fill out the JAMS demand and go from there? Will they Arbitrate over 584.00? Do you think they will just say the heck with it, it will cost them much much more to arbitrate.

I really am new at this, I can write letters and lick stamps, but I don't want this new thing on my reports. Any insight on what to do would be most appreciated.

It could help you out because arbitration with JAMS is very expensive and if there is a clause saying directv will pay for the arbitration or even if they won't and you want to then it could make them not want to do it and they never pay or go there and the case withers away. You can't file for arbitration tho until there is a lawsuit filed against you. Then when you answer it you ask for JAMS and you deny the debt.

i am in the same situation with direct tv and they say I owe about the same.

Call them tomorrow and tell them you need a box for the equipment. When you go to fedex make sure you keep the receipt, its the only proof you will have if it goes to court.

Are they trying to add on early termination fees?

Did you know they have already been sued in every state for these very same issues.

Well, I just called them, and they said that it was too late to return the the equipment, and that it was stated in my 1st bill. And that there was over 300 bucks worth of early termination fees. It would seem that my situation would fall under the AZ ruling. Time to go to the Attorney General Again.

This is wrong. Arbitration is intended to be a form of dispute resolution without evolving the courts and should be invoked without filing. The contract will have procedures for starting the process. Often it means sending a letter to a specific department with your complaint. If that department does not resolve the issue, then you notify them that you are electing arbitration and follow the procedures.

Well that may be true but I wouldn't pay out all that $$ to arbitration UNLESS I was being sued. I guess thats what I was inferring. Once I was sued I would ask for arbitration. I might threaten to go to arbitration tho so that they would avoid suing me. Maybe they would be more willing to make a deal or pick up their merchandise.

These are the execs at Directv. I just sent the following email:

Ladies and Gentlemen,

I received a notice from CBCS in the mail on February 4th 2012 that I owed a debt to DirecTV for the amount of 584.12. When I called customer service I asked for an itemized accounting of the charges. To my surprise they listed over 300.00 worth of “Early termination fees” and 2 non-return fees. I explained to the customer service representative that I did not receive a box and label to return the equipment, she proceeded to tell me that they sent the box to the billing address. Well, the reason I cancelled my service was because I was moving, because of Military orders. If you think about this for a second, the box show up at an address where I do not live, I never signed for it, and apparently the landlord disposed of the box. I have your equipment, and am willing to send it back, but the customer service representative said that it was too late, and that I was told that on my 1st bill, along with being informed of the early termination fees on my 1st bill.

I am not completely sure, but I think this falls under the AZ Attorney General’s lawsuit against DirecTv, disclosing the “terms” after the contract was initiated. I have no problems paying for the service I received, but I do have issues with paying for equipment that I never received a return label for, and for early termination fees that were not disclosed prior to entering into a contract with DirecTV.

My account # is xxxxxxxxxx please investigate and correct the balance owed.

If I get no response from someone today, I will be filing a complaint with the Arkansas Attorney General and also alerting the AZ Attorney General that your company is continuing to practice business in direct violation of the settlement agreement.

AH! I have an idea!!! Donate to goodwill and get a tax deduction!!! :twisted:

....or did they change the law on that kind of deductions??:cry:

Thats great!! Good for you!! I wonder why they dont' want their equipment back? Save your emails just in case something happens and make copies too. I would donate it to a charity too.

Probably because it's not worth what they were charging him. I've heard that they're getting those things back left and right too, so they should have plenty to spare.
