Too general to answer. For one thing, are you filing a 7 or 13? And you file bk, you don't file a bk against a lender.

Also, check your mortgage paperwork. You may have pledged all rents as security in case of default. This is pretty standard if the property was a rental from day one.

The tenant would ordinarily stay until a foreclosure or eviction took place. The bk is really only step 1. And if they're paying rent, then the lender may take the property back with the tenants.

Are you underwater? Have you discussed with your lender?
