Who is the named plaintiff in the suit? Cavalry spv2. What is the name of the law firm handling the suit? winn law group3. How much are you being sued for? 6k4. Who is the original creditor? boa6. How were you served? in person at the door7. Was the service legal as required by your state? yes8. What was your correspondence (if any) with the people suing you before you think you were being sued? received letters from both law firm and cavalry saying they just purchased the account with the 30 days to dispute 9. What state and county do you live in? CA, los angeles 10. When is the last time you paid on this account? 3 years11. What is the SOL on the debt? To find out: 4 years12. What is the status of your case? answer was just filed 13. Have you disputed the debt with the credit bureaus (both the original creditor and the collection agency?) No14. Did you request debt validation before the suit was filed? yes15. How long do you have to respond to the suit? 30days Please post what they are claiming:charges are account stated and money lent 1. principal of damages in the sum $xxxx2. interest on that sum at the legal rate of 11.240% per annum form 20093. cost of suit and;4. such other relief as the court may deem just and proper.same wording for both cause of action.No questionnaires or no evidence was sentdont know how far these guys wanna play but for over 6k they may make me work for this one. They will probably balk, so you will need to be ready to file a motion to compel...Or, look and see if you can do arbitration per the cardholder agreement...
