usagi555 Posted March 20, 2012 Report Share Posted March 20, 2012 Here's the deal:My sister just received a collection notice for her mother-in-law, who lives in LA, over a Hollywood Video account. From what was described, this letter has no maxi-miranda, for starters. There's obvious third party disclosure here. The real kicker is when I did a license search on the CA, Universial Fidelity. They are not licensed as a CA here in NM, where the collection activity took place. They had a license at one point, but it is inactive. I can point to the case law that says this is an FDCPA violation and I can point to the NM statute that says this is a FELONY. It matters not that my sister's MIL no longer lives in the state. I'm going to try to convince my sister's mother-in-law to sue on this one, especially considering the stories floating around about Hollywood Video accounts and collection agencies. My sister's MIL is not going to take something like this on pro se, so I need a good consumer attorney. I'm talking about the kind who has filed and won FDCPA suits before. I'm talking about the kind who's eyes will light up. I'm going to scare them off this afternoon for fun, using nothing but a phone call. I am seriously thinking of Law School after all of this. Since I have the VA and GI Bill I can use. This site is great. Hoping to file my 1st motion for default judgement Friday Morning at 8 am. crash5050 Posted March 22, 2012 Report Share Posted March 22, 2012 You an represent her if you have power of attorney, I think it is called Pro Se in Havoc or something to that effect. I am in the process of dealing with a Privae Student loan that my mother in law sc-signed for my 18 year old daughter. We're not talking about me giving some opinion on what would happen under the law if x, y and z were done, we're talking about representing somebody in court.
