Bobby2012
Cap1 filed suit which has been defended for several months. And then files a second and asks the court to allow consolidation. Can this be opposed? Should it be opposed?
legaleagle
No, this is normal. Courts don't want two or three suits involving the same parties. It will be all or nothing for them now. Even if they didn't file, the case management coordinator at the court would order consolidation.
usagi555
Knowing that banks don't have the spotless records that the general public thinks that they do, I would personally want both cases consolidated. If the records *looked* decent for one account and terrible for the other, I would use the second account to attack their record keeping practices across the board. On top of that, running two cases at once would be a lot of extra work and stress.
