lilacbouquet Posted March 21, 2012 Report Share Posted March 21, 2012 I recently wrote a validation letter to a company trying to collect on a debt I do not owe. I was just reading about validation letters again because the 30 days is up on Friday and I have not received a response. However, I did not see the part where it says I had to write the letter within 30 days of receiving notice of the debt.So, is my validation letter totally moot because I didn't send it within 30 days of noticing the debt on my credit report? I did dispute the debt with the bureaus within 30 days, but they just marked it as investigated and left it on my reports.I was getting so excited b/c the 30 days is almost up, and now I am wondering if I am just stuck with this negative item on my report! Coltfan1972 Posted March 21, 2012 Report Share Posted March 21, 2012 The CRA has to investigate and answer the dispute within 30 days, no matter when you send the dispute.For DV you have to request DV within 30 days of their initial communication with you. Initial communication is the tricky part when you just notice something on your credit report. In any event, on a DV, they don't have to respond within 30 days (under the FDCPA) and on a CRA dispute if they don't respond within 30 days the neg entry has to be removed. I am going to dispute with the bureaus again because it has been more than 7 years, 180 days from the date of first delinquency and the item is still showing up on my report. I am learning a lot. I just saw three new alerts posted to my Experian account -- this is the first time I have ever heard of this particular company. I have received no mail or phone calls from them. I am going to send a validation letter since it is within the 30-day period. Hopefully, I can get rid of them.
