purplebb
Anyone know if a CA can collect on a debt from hollywood video? I heard that they agreed not to collect on anything after they went bankrupt. A family member of mine got a notice from universal fidelity trying to collect on some fees from over 3 years ago when they closed down. And never had any contact before this. They are out of texas and we are in oregon. What should they do?Thanks.
usagi555
This is a major scam. Send a DV, find a consumer attorney and sue them for overshadowing the maxi-Miranda required by the FDCPA by placing it on the back of the letter while telling you what a good collection agency they are on the front. It is also very vague as to who they are actually collecting for. There are probably other violations they committed as well. See if CAs are required to be licensed in your state, and if they are, check to see if UF LP is licensed. They are required to be so in NM and they are not licensed here, meaning that every letter that they send out is a felony. They know damn well that they need to be licensed as there are records of an expired license in their name. My sister's mother in law supposedly has a debt with them and the letter was sent to my sister's house where her mother in law has never lived. And check to see if they've reported to the CRAs too. It also uses wording that universal fidelity is the is collecting on behalf of the legal successor of hollywood video, but it never says who the legal successor is. It does list some rentals on it that it claims the charges are from. What does that even mean? Legal successor? My state does require that a CA be licensed, but do they have to be licensed in my state or theirs, or both?

I am interested in seeing if the courts would consider it a violation for a CA collecting in your state if they need to be but aren't licensed in theirs, however. As for legal successor, they probably mean the bankruptcy trustee, but who knows with these nematodes.

There you go again, using your ESP powers for good. To the OP,I believe that to collect in your state, the CA would have to be licensed there IF it's a requirement. Whether they are licensed in their state, or whether they even have to be is another matter entirely. If you want to know though, call the Attorney General in TX and ask if they are on the list.
