franchise tax board sending collection letters to my customers

Recommended Posts

I need help! I owe money to the franchise tax board, and they had sent letters to employers in the past. Now they are sending letters directly to MY customers. How can the FTB expect my customers to with hold money for services when they may only get invoiced once a year? Is this an attempt to harrass me into dealing with them finally? it IS awefully embarrassing to have your CUSTOMERS and not your employer get these letters demanding with holding. Is it lawyer time or what? Is there a way to get the FTB to stop sending letters to every manny moe and jack who I've ever invoiced?? what gives? Thanks!!--T

Get a lawyer. They're trying to hold your livelihood hostage, and you need to put a stop to it NOW. This is in no way acceptable behavior for any government agency and every single one of the people there who think that what they're doing is justified should be fired to set an example for the others who forget who they really work for, though that won't actually happen.

When you say YOU owe, do you mean you specifically, or a business owned by you owes? If it's the latter, see if there are any applicable torts, especially debt collection torts, in Cali, that are based on an invasion of privacy.

Actually, the IRS probably does the same thing to self-employed people who are not paying their taxes. They will look through the 1099s sent in your name and then levy the accounts through your clients. For the IRS/State government taxes (which I believe this is), this action has been considered acceptable.

In fact, judgement creditors are also allowed to levy account receivables (if you look at financial disclosure forms, they do ask about those) in the same manner.

I would suggest getting this taken care of so that they stop levying your account receivables.

I looked up what the CA Franchise Tax Board is and this confirms my above post. In other states, this would be the Dept of Revenue or Finance for that state. I am betting you have past due income taxes and the IRS shared with them you 1099s and so they are now trying to levy those for the taxed due.
