What i learn here she will review and help guide me. the attorney does not want to take the case only because he does not want to take money from me that i may need to pay creditor if for some chance I have to settle.I have checked all three credit reports and the account Captial one is suing for is not listed on either one. The credit card had the corporation on it, and for that reason it is not on my personal credit report. HOW DO I GET A REPORT FOR CORPORATIONThe suit is for I closed this corporation last year. willingtocope Posted March 27, 2012 Report Share Posted March 27, 2012 Even though it had the corporation's name on it, you probably had to personally guarntee the card...if the company didn't pay, you will.business related debt is not covered by the FDCPA, so you're kind of between a rock and a hard place.You can get a report for a corp from Dunn & Bradstreet, but that really doesn't help much.Because of the personal guarantee, this is now a personal debt...which will show up on your personal Crs sooner or later. It has been 3 years since I closed the business.The information I am getting from everyone is wonderful, I have been reading Colorado small claims CRS, etc until it is coming out of my ears. I was hoping for this to get more clear in my head, but I am getting overwhelmed. So where is the good news now? Sorry, just seems like a ton of money to pay somebody for an opinion when your doing all the research. If your happy then I guess that is all that counts. Generally speaking, an attorney in a collection suit either is a junk yard dog and will win no matter what, or will just tell you to settle. It's one extreme or the other. Looks like this one is already setting you up for the inevitable, "you just need to settle" advice. But good luck !!!! If it works for you and your budget, then great. Barney Posted March 28, 2012 Author Report Share Posted March 28, 2012 Thanks for the info, I do not want to settle, I just am having a hard time understanding all of the legal jargon, I don't think it would be smart to put something down on my answer that I really do not know what it means. I have been given a lot of great information on this site and I am doing my best to determine the best course of action. I prefer to not pay an attorney for any help, BUT I want to win and time is getting short. It seems like one mistake and my ship sinks in the water, and that is the last thing I want to happen. I just think $150.00 an hour for assistance from somebody that is not an attorney and you doing the research and just running the info by them is highway robbery. You can usually get the info here for free. You can also post your pleadings and generally speaking get some great feedback. I've got a whole folder full of saved post links, that can be used for just about anything that comes. I"m convinced if somebody came to this forum and asked for a sample motion to compel the other side to produce dinosaur bones and the horn of a unicorn, in ten minutes somebody would have a redacted of personal information motion they used in court for a similar case. On the flip side, the posters giving you the advice won't be standing with you in court and/or paying the judgment if you take the wrong advice. I will put some of my pleadings along with content of the complaint. I know I will get some great responses and I hope I do not need an attorney.
