I've been served with a civil complaint at the district magistrate level by Cap1 for $1400, and after consulting with an attorney I don't feel my chances are good at winning in court so I would like to settle.

I can pay the full amount, but it will put me in a tight spot for a few weeks to do that so even if I could settle at say 80% it would make the whole ordeal a little less painful.

Cap1 does indeed still own my account, but since one of their local rent-a-lawyers has filed a complaint against me, and we are scheduled to appear at the magistrate's office next month I'm unsure of who I should contact to try and settle this. Would I call Cap1 Recovery or the attorney?

At this point do you think my $1400 will turn into an even higher amount because the lawyer will try and tack on the filing fees he paid for filing the complaint against me?

You can probably get 50% or so. You have to deal with the attorney, tell him you would like to settle, start at around 40% and see what happens.
