Or should I try to get them removed since they are past the sol? Or do most collection agencies tend to try to keep them on there for 7 years? jmf8756 Posted March 28, 2012 Report Share Posted March 28, 2012 I would send a request for validation. If you truly are past SOL, you probably don't have anything to lose. There's a good chance the collection agency can't prove that it's yours and they will delete it. If they validate and you confirm that you do owe, you could do a pay for delete. I have had a couple deleted because they have not been able to validate, but I have not tried to pay for delete anything yet. I guess it depends on the collection agency as to whether or not they would go for that, but I would definitely want something from them in writing before I paid them. I would like dv? if they are not able to validate it have them remove it or what?If these agencies have tried to contact you in the past, you'd be outside the 30 day initial contact window requiring them to respond to a DV request. If they haven't contacted you at all, the same thing would apply. They haven't made an initial contact.If they don't validate, they can still report. What you need to do is dispute the accounts. You can do it 2 ways. One is throught the credit reporting agencies. Making the first dispute through the CRAs gives you a private right of action against the credit bureau or the collector under certain circumstances.Or you could dispute directly with the collections agencies. Send a letter stating you dispute their entry on your credit report. Send it CMRRR. They must then report the debt as disputed on your CR. If they don't do that, they're in violation of the FCRA. I don't know if you'd have a private right of action, but they'd still be in violation.If these accounts are outside the SOL for collection, I'd simply dispute them. If they remove them, great. If not, they don't have much longer to remain on there. The older the negative entry, the less effect it has on your CR if you have current positive entries.
