Just when I thought I was in the clear (ER Solutions, Capital Mgmt, & JCC Christensen

Hello All!!

I have receive some sound advice from this forum, so I was hoping someone would be kind enough to help again. I am still navigating through credit repair, so forgive me if I mix things up or sound like a total goob. :oops:

Ill make it short and sweet:

To date, I do not have any debts that are within California's SOL. In fact, I only have 1 remaining debt with a CA and one paid debt that I was not smart enough to get a PFD remaining on my CR. Both fall off this year from my CR.

What I am experiencing now is robo calls from ER Solutions, and collection letters from JCC Christensen and one from Capital Management. I have NO IDEA what debt ER Solutions is calling me about, since it is always a robo call. Again, there are no debts that I am within SOL. JCC & Capital Management are trying to collect on two different debts that are NO LONGER on my CR (successfully disputed them with the CRA's) and are both 5 years PAST SoL.

I sent a zombie letter type of thing (again, here is my newbie status showing) to both JCC & Capital. I sent Cap's with CMRRR. I foolishly sent JCC to their PO Box, but then later I sent another zombie letter to JCC when I found their physical address here on this forum. I sent them CMRRR as well.

Here is my questions.....Are they JBD's? Should I even be concerned? My biggest concern is the letter i sent to JCC is beyond the 30 day validation time frame from when they sent me their letter. I wasnt too worried at first because I knew that they were beyond SoL. Then I realized the letter they sent me was dated in February, but the date on the mailing envelope was late March.

I dont know what to do about ER Solutions calling me since I can never get a live person.

Any insight or advice is appreciated. It has been nearly 2 years since I have been bothered by any CA's or JDB. This sudden contact from 3 different ones has me in a tizzy.

They are junk debt buyers. Concerned, why? According to your post, unless you have an outbreak of complete stupidity and restart the statute of limitations, what can they do.

Actually I look at it this way. A JDB that is outside the time to report on your credit report or legally sue you in court, is just begging for a lawsuit. While it's not technically illegal to contat you on such debts, if they engage you in conversation, there is almost nothing they can say short of just begging you to pay, that won't violation some consumer protection statute.

This is with you doing no "baiting" as the collectors like to call it. We at CIC call it simply offering two choices, option A. obey the law, option B. violate the law. Option A is usually not very profitable on these type of accounts, so not used often. So to justify using option (B) collectors like to call it baiting, because it sounds better than "illegal"

ER Solutions has the distinct honor of being a 2 time contributor to my Latin American Palace Retirement Fund...in fact, they are about to become #3...

So ER Solutions - now Convergent Outsourcing is just a CA.

JCC and Capital Management are JDBs - and according to some sites, another tentacle of the LVNV tree.

For JCC and Christen, since you know those are OOS debts, you can send a C&D anytime you want and be done with them.

As for ER Solutions, do they give a call back number? Have you tried to call them back? If not or if trying to contact them does not get you a human within 7 days, send them a C&D letter. If they cannot get you to a human to explain why they are calling, then don't be bothered with a DV.

Ok to clarify...

The number ER is contacting me on is my cell phone. They never leave a voice mail. Rather, when I answer, there is a robot on the other end stating who they are and that they are looking for a (insert my first and maiden name) and if I am that person, then they have a urgent message to speak to me about. If I am not that person, then to press #4. I was so freaked by getting a call like this, I pressed #4 and the robot said, "sorry for the inconveinence." The next day, same call, same exact things said.

These debts are past SoL in California, so I honestly thought I would never hear from another CA/JBD again...(insert stupid look here)

Does the zombie list also double as a C&D letter? Should I wait again to see if I hear from them and then send a C&D letter?

Also, in regards to ER, since I have never spoken to a live person, but they keep calling my cell phone, can I send them a C&D letter without noting what debt they are trying to collect?

Did you ever give the original creditor your cell phone number? If you did, you can revoke permission with the OC. If this is a JDB calling, revoke it with the JDB.

If you never gave the OC your cell number, the CA or JDB is in violation of the TCPA. Therefore, check the laws of your state and the state of the caller to make sure you can record calls. If you can, record the call next time you answer. Also, keep their number on your caller ID.

Actually, my cell number is brand new. The OC was from YEARS ago, so I know I never gave them the number.

I recently applied for a credit card and was approved. I see on my inquiries that they listed my cell number I gave when I filled out the application.

I am under the impression that ER got my cell number from pulling my CR. I saw they pulled my CR 3 weeks ago. It was a hard pull too. I asked a ? About that in another thread, but so far no one has responded.

Your cell phone is on your credit report? That might possibly be considered express permission because your number is available for people to see.

quick question...

since i was the one who put my new cell # on my recent credit application, therefore giving them expressed consent, what do i do in the future when applying for credit? Leave the area blank? fake number? we only use cell phones, no land lines at home.

This is my opinion - so take it at that...

If I give my cell phone number to someone, I am giving ONLY that person/business permission to use it. If it is put on my credit report, and someone else calls me without permission, then I will let them know not to call me on that number - if they call a second time, I sue for harassment.

You can count me as part of this illustrious club too.... fingers crossed.

To the OP, I'm also involved with ER ie; Convergent Outsourcing. Notorious for buying / attempting to collect on out of SOL debts.

Rather than just sending them a C&D letter telling them to pound sand though, I've tried another option, hoping to *bait* them back and collect $.

1st Step and Coltfan, BV80, and WhoCares1000 are right on the money here - relax, you can do almost nothing other than resetting the SOL to actually have to pay them if it's out of SOL. Tough luck for them...

Just keep learning here and figure out how to nail them if they keep bugging you.

I just hope they dont try something scumy and use the signature I put on the DV on a promise to pay or something like that, in order to restart the SOL.....although, I did sign the DV with a obvious, this is not my real signature, type of signature. I also kept a copy of the letter.

It's good that you kept a copy of the exact letter that you sent.

Hopefully that included the signature as well.

I typically print my name, then sign directly *on top* of it.

Let them try and extricate my signature from that mess to use against me on some forged documents... hahaha....
