formercreditidiot Posted March 28, 2012 Report Share Posted March 28, 2012 Can a CA/JBD place a past SoL debt on your CR?If yes, after I dispute with the CRA, are they (CRA) obligated to delete it or does it remain for 7.5 yrs on the CR?I'm confused. I know the difference between SoL and the time frame a date can stay on your CR, but I've read a few things here that got me thinking I have it wrong.If a CA/JBD validates a out of SoL debt, can they legally report it to a CRA? poppet24 Posted March 28, 2012 Report Share Posted March 28, 2012 From what I understand - all the SOL means is they can not sue you for the debt, but they can continue to try and collect for it as well as report it to the CRA's. Coltfan1972 Posted March 29, 2012 Report Share Posted March 29, 2012 They can report the debt regardless of what the statute of limitations for being able to collect via court is. The limits for reporting and being able to sue (acutally being able to use the SOL defense) are 100% independent of one another. A negative entry can remain for 7 to 7.5 years after that date. If it's been 8 years since your very last payment, the entry shouldn't be there. In my state (depending on the court and arguments) a credit card debt has a three year state. So if I defaulted on a credit card four years ago, the debt would be past my state's SOL for legally suing, but could still be reported on my credit for three more years. I was just wondering if when disputed with the CA/JDB, if the CA sends the debt BACK to the OC, if the OC can reinstate the debt on my CR.....however, you both answered that, with NO it cannot be on my report if 7.5 years past DOFD.thanks again, guys.
