I had identity theft 2 years ago, and filed a police report 1.5 years ago. Equifax has cleared most of my negative items. However, those collection accounts are still reporting to Experian and Transunion. Now, here goes the question: Can this credit report from Equifax be used to get these items off of the other two reports? If so, how can it be accomplished? Hopeful1 Posted March 29, 2012 Report Share Posted March 29, 2012 (edited) I smell a lawsuit here...Are the items marked as "disputed" on your reports?I would see if any veteran members get to your post, but I don't think you can use the info from one CR to get them removed from the others. Does that mean that Coke and Dr Pepper will too?same concept, in a nutshell.There is ONLY ONE situation in which the above WILL and DOES apply....and luckily for you, yours is that situation. If you have filed the ID Theft paperwork properly, and these accounts that are a result of the ID theft are still on your reports, by law THEY MUST BE REMOVED.Send the two that didn't remove a copy of your ID Theft police report with the affected entries on your report highlighted and remind them. I am kind of in the same situation...I haven't filed a police report yet, but these things happened 5 years ago... is it too late to file a police report now ? aboss3 Posted April 12, 2012 Author Report Share Posted April 12, 2012 Experian replied that my paperwork was missing Police Officer's signature in the FTC affidavit and therefore they will not take it as it's not up to the FCRA's standards. Can they legally do it? I read the whole FCRA, especially part 605(A) and 605(, and sent them a reply citing that they are in violation. Waiting to hear back. It's Experian that refuses to take the item off. The thing as I described above was that they replied in 5 days with a letter stating that my FTC affidavit is missing an officer's signature, which it shouldn't have as I was providing a separate police report. If you have, send it again and let them know that unless they delete the item, they will find themselves the defendant in your County Courthouse.
