Account assigned to numerous CAs, one violating FDCRA, now back to OC for collection!

Recommended Posts

Hello Community ;

Thank you in advance for your assistance. I am in a situation where I truly did not know I had this obligation nor do I even NOW have the proof that it is mine.

Let me expalin: I had alot several of these Bank Card bills which were all paid. This one then appeared after about a year (one bank sold to another, I think).

I honestly do not think they can substantiate chain of ownership. Here is the rest of the story...

This CC (bank) company "assigns" an alleged debt to numerous sequential Collection agencies -i.e., cms, erc, mcm, fbcs. I was so confused I thought it was a mistake since I paid all the others. So, I send Debt validation letters to all by March 2011. One would back off, another would be assigned and 'round and 'round we go.

One of these new agencies violates fair debt and collections act. I called them on it. In Nov, after sending # letters to various agencies, Def challenges chain of ownership as well as stating violations of FDCRA. In Nov 2011, last collection agency backs off, sends letter stating holding off until further evidence can be mailed but asks D. to state either: 1) a full dispute of account , 2) dispute due to fraud, 3) dispute portion of account, 4) agree with the debt.

I advised that I still did not have knowledge of alleged account, stated it could be fraud (I DID have a lot of mail stolen while I was living overseas); then in end of March 2012, I get a letter from the ORIGINAL CREDITOR stating they found a payment made on the account from 2006! (on one of my checks but not not signed by me!).

What should be my next step? Chain of ownership? Do I have to address the check from 2006! I Any suggestions as to next actions?
