bohey
I have had mail stolen repeatedly over the years and just recently had checks mailed to me stolen and forged (Yes, and the person even spelled my name wrong!) In years past, when the banks were sending out statements with "blank checks" included. I ended up with thousands of dollars of bogus purchases. I have written letters to these alleged JDBs stating this and informed them I had written to postmaster general and filed a police report, so leave me alone. They are now sending me affidavits of fraud asking for my DL#, my SSN, my DOB, Bank Account. etc. I am not giving these JDB's ANY of my personal info but how do I respond without giving them too much info? They say I have 30 days or the debt is considered owed.
legaleagle
I would never give any personal info to them. If they truly represent a creditor, the creditor already has this info, get it from them. If they haven't sued you yet, this may be an FDCPA violation. They are attempting discovery on a nonexistent case. The most I would give them is a copy of the police report, if you have it. Tell them the rest is privileged and improper. OMG!!! Oh, just take it out of there, why doncha?" (Are you kidding me~!)
BTO429
Send a cease and desist letter they will either comply nor comply or sue either way the last two choices you still end up in court.
Coltfan1972
They say I have 30 days or the debt is considered owed. They can consider it owed all they want, who cares. I could care less what a JDB considers owed or not. They consider it owed, you consider it not owed. Big deal, let's see what a court considers it, if they were to sue. Something tells me the judge is going to want more evidence than, "We consider it owed to us your Honor."
bohey
Thanks, guys. I certainly did not intend on giving them anything, but was unsure how to proceed ... send a nice letter saying "good try, but go fly...?" I think it very underhanded verging on violation of privacy, security, harrassment ...
