Confusing chain of custody.

Hello everybody!

First of, as a new member, I would like to thank this forum and everybody who contributes here for the renewed hope you all have given me! I have lost track of time for the past few nights reading up all the information here. Please continue doing what you doing in hopes of helping other people.

Now to the question. I have 2 collection accounts on all 3 CRA websites that belong to one CA: Equable Ascent Financial LLC. Going through my records it looks like Equable themselves never attempted to contact me on the matter. Reading up on them revealed that they like to mimic themselves as the original creditor and let other CA loose on their behalf. My records reveal that 2 different CA contacted me concerning the first account, and another on my second one. They have kindly informed me that Equable assigned my accounts to them. Armed with the info from this forum I sent out 3 DV’s this morning. Ultimately, plan of action is to settle to delete one account and fight the second one. Now, after dealing with their proxy agents (successful, hopefully) how should I go after Equable Ascent Financial’s to remove or alter listings?

CAs don't buy debts. Junk Debt Buyers (JDBs) buy debts. Both Ocs and JDBs contract (i.e.,"assign") CAs to do their hassling. So far, you've done the right thing by DVing the CAs.

But, I personally would never "settle" with a JDB unless ordered to by a court. You don't owe them a penny, and they seldom have the documentation to prove otherwise. They've paid pennies on the dollar for your name on a list...

Deal *directly* with Equable ONLY.

Not their 'goons' as one of the esteemed frequent posters on this board called them in one of my Equable Threads.

I'm in a situation where two different CA's, a year apart respectively, have tried to collect for Equable here in MA. (btw, Equable isn't licensed here in MA, so their CA's have to be)

Here's the thing though - if their CA's don't send you Debt Validation, then what? Can you claim that Equable *knew* what their CA's were doing? Maybe, but can you prove it? Doubtful. That's what I'm dealing with, a sort of 'whos on first, whats on second' parody.

I also wouldn't settle with Equable or any JDB until they prove that I owe them anything, which of course, they won't be able to do.

Search my threads, there is some good insight from esteemed board posters on it that may give you a bit more insight.
