Kohn Law Firm - Capital One Jugement

I hope someone can help me or give me some directions.

I was notified by the Kohn Law Firm of Milwaukee on May 1, 2006 that they were retained by Capital One Bank to collect a debt of over eight grand.

I sent out a letter of Validation to Kohn on May 5, 2006. They did not answer it or provide the information requested. The letter was sent certified mail with return receipt requested, (I have copies of everything).

On a letter dated October 12, 2006 I was notified from Kohn that an order for Judgement had been issued. Kohn states in an affidavit of mailing that the judgement had been sent to me on October 13, 2006.

The copy of the judgement is not dated or signed by the court. A case number is included with the judgement. A search on line finds that the filing date with the court was on August 4, 2006. And that the judgement was issued on October 23, 2006.

Besides having my head in the sand over a business that went south and wiped us out. I’m just finishing up another judgement from Kohn and I believe as soon as the current judgement is paid off the next one will kick in.

My question is do I have any recourse to get the judgment removed, dismissed, etc because Kohn never validated the debt in the 30 day time frame that was stated in the letter of validation and if so does anyone know a law firm in WI that works with type of case or am I just out of luck and will have to pay this.

Any help is appreciated.

Not really. What is bringing the judgment up now? Are they harassing you about it? A judgment that old is going to fall off your credit report (if it is still on there) in like 20 months or so.

Nothing has brought up the judgement, but I'm aware it's out there and concerned that Kohn will start up a new garnishment after the one that I am paying them is satisfied in about 3 months.

Wisconsin has a program, called, I think, Chapter 128, in which you can pay off a judgment over a number of years.

I think, if you do that, they can't garnish you.

I'm not from WI, so I'm not familiar with it, but have seen it discussed here.

Look up postings from Trueq, who is from WI and has mentioned it.
